By accessing or using the AI assistant services ("Services") provided by AigonPay Limited ("we," "our," "us," or "aigon.ai") through WhatsApp, Telegram, or other supported messaging platforms, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.
If you are using our Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
We provide AI-powered personal assistant services through messaging platforms, including but not limited to:
Services are provided through automated AI systems without human intervention unless specifically stated. Different assistants may have different capabilities and data retention policies (persistent or ephemeral).
To use our Services, you must: - Interact with our bot through a supported messaging platform - Provide a valid identifier (WhatsApp phone number, Telegram ID, etc.) - Optionally provide a display name (can be a pseudonym)
You are responsible for: - Maintaining the security of your messaging platform account - All activities that occur through your account - Notifying us of any unauthorised use
By using our Services, you represent that you: - Are at least 13 years old, OR - Have parental or guardian permission if under 13 - Have the legal capacity to enter into these Terms
You may use our Services for lawful purposes including: - Personal productivity and assistance - Educational and homework help - Professional tasks and research - Creative writing and content generation - General information queries
You must NOT use our Services to: - Violate any applicable laws or regulations - Infringe intellectual property rights - Generate or distribute harmful, offensive, or illegal content - Attempt to harm minors in any way - Impersonate others or misrepresent affiliations - Transmit malware, viruses, or malicious code - Attempt to gain unauthorised access to our systems - Engage in academic dishonesty (submit AI-generated work as your own without permission) - Generate spam, phishing content, or deceptive material - Create content promoting violence, hate speech, or discrimination - Circumvent any technical limitations or security measures
When using our Services, you acknowledge that: - You are responsible for all content you submit - We may refuse to process inappropriate requests - Educational assistance should be used as a learning tool, not for plagiarism
The Services, including all software, algorithms, designs, and documentation, are owned by AigonPay Limited and protected by intellectual property laws. You may not: - Copy, modify, or create derivative works - Reverse engineer or attempt to extract source code - Remove any proprietary notices
You retain ownership of content you submit to our Services. By submitting content, you grant us a worldwide, non-exclusive licence to: - Process and analyse your content to provide Services - Store content as necessary for service functionality - Use anonymised, aggregated data to improve our Services
Content generated by our AI assistants: - Is provided for your use under these Terms - Should be reviewed for accuracy before use - May not be unique (similar queries may generate similar responses) - Should not be relied upon for critical decisions without verification
Your use of our Services is subject to our Privacy Policy, available at [aigon.ai/privacy]. By using our Services, you consent to our data practices as described in the Privacy Policy.

Our Services are currently provided free of charge.

You agree to indemnify, defend, and hold harmless AigonPay Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: - Your violation of these Terms - Your use or misuse of the Services - Your violation of any third-party rights - Content you submit through the Services
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: - WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - OUR TOTAL LIABILITY SHALL NOT EXCEED £100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER - THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
Nothing in these Terms excludes or limits liability for: - Death or personal injury caused by negligence - Fraud or fraudulent misrepresentation - Any liability that cannot be excluded by law
You may stop using our Services at any time by: - Ceasing interaction with our bots - Requesting account deletion via privacy@aigon.ai - Blocking our bot on the messaging platform
We may suspend or terminate your access if you: - Violate these Terms - Engage in abusive or harmful behaviour - Use Services for illegal purposes - Exceed reasonable usage limits
Upon termination: - Your right to use Services ceases immediately - We may delete your data per our Privacy Policy - Provisions that should survive will remain in effect
Before formal proceedings, you agree to attempt resolution by contacting us at legal@aigon.ai with: - Description of the issue - Supporting documentation - Proposed resolution
We will respond within 30 days.
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where prohibited by law.
WHERE PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
These Terms and our Privacy Policy constitute the entire agreement between you and AigonPay Limited regarding the Services.
We may update these Terms by: - Posting revised Terms on our website - Notifying you through the Service - Updating the "Last Updated" date
Continued use after changes constitutes acceptance.
If any provision is found unenforceable, the remaining provisions shall continue in full effect.
